It was a regular welfare check by the Mansfield Police officers over a car on the side of the highway. They found the client asleep inside. Suspecting that something was not right, the officers conducted all roadside field sobriety tests on him. The client failed and was consequently arrested for DWI.
Later, the officers secured blood samples through a search warrant to test for blood alcohol content (BAC). The results came back at 0.14, and a Driving While Intoxicated charge was filed. This is the second time the client has been charged with a DWI.
Texas law classifies an individual as intoxicated when their blood alcohol content (BAC) reaches 0.08 percent. A second-time offender can get one month to a year in jail when convicted and pay a fine of up to $4,000. In addition, they could lose their driver’s license for two years. DWI cases also include a state fine of up to $6,000 assessed upon conviction.
During the trial, the defense noticed that the District Attorney focused too much time on the issue of intoxication but glossed over the actual “operating” element of the case. For DWI cases to get a conviction, the prosecutor must prove that the accused was operating a motor vehicle in a public area while intoxicated. There should be evidence that supports these elements beyond a reasonable doubt.
When the last of the State’s evidence was presented the defense moved for a directed verdict from the judge, who rendered a verdict of “not guilty”. The trial lasted for two days in Tarrant County, Texas.
