Matav Reports Motion for Class Action Concerning Content of Sport Channels
NETANYA, Israel, December 4 Matav-Cable Systems Media Ltd. (Nasdaq: MATV News), a leading Israeli provider of digital cable television services, today announced that on December 3, 2002, a motion was filed in the Tel-Aviv-Jaffa District Court for the approval of a class action against all three Israeli cable companies, by seven Israeli residents. The plaintiffs seek recognition of their action as representing 1,050,000 subscribers of all three cable companies. According to the claim, the cable companies violated the terms of the approval given to them by the Israeli Cable and Satellite council (the Council) for the transmission of the pay sport channel (offered to subscribers through the new tiering services) since they did not maintain certain programs in the original sport channel which is part of the basic package offered to subscribers.
If the motion for a class action is approved, the court will be requested to instruct all three cable companies to compensate the subscribers by a total sum of NIS 302,400,000 as of the date of the motion and by an additional sum of NIS 25,200,000 for each month passed, from the date of filling this motion until a final judgment is given by the Court. According to the motion, Matavs share is approximately 26 percent of these sums. The company is studying the details of the claim.
The motion states that a similar motion was filed on December 3, 2002 against D.B.S. Satellite Services (1998) Ltd. (DBS), by some of DBSs subscribers.
Matav is one of Israels three cable television providers, serving roughly 25 percent of the population. Matavs investments include 7.5 percent of Partner Communications Ltd., a GSM mobile phone company, and 10 percent of Barak I.T.C. (1995), one of the three international telephony-service providers in Israel.
